New Creative Lube

Easy versus Right

Today we learned that Google has come out with Image Search. You input your image and Google finds it on the web. Sounds great–an easy way to find infringing uses of your work. Wonderful! Free! Huzzah!

Except, it really isn’t free. You’ll pay for it, just as you do for all things Google. It’s just not so obvious as getting a bill every month.

Remember, Google is no friend to creatives. In fact, I would go so far as to call it a full-on enemy to creative professionals. The laundry list of its abuses is almost endless: promoting pirated films on YouTube (even those not actually posted on YouTube); the evil book project and its rights-grabbing attempted “settlement”; selling its ads on just about any site out there, including aggregating “blogs” who copy content wholecloth and without permission as well as sites with pirated music or movies; giving money to groups which are against strong creators’ rights (like EFF and PK)… basically, Google doesn’t care what it does as long as it can spin it so that people will think it’s not all about the money while it’s all about the money.

Image Search is another such move. It’ll sell ads and make money off creatives (and regular folk) who use the “service.” It’ll use that money to continue to exploit and fight challenges by creatives who seek to protect their rights. Also, it’ll hurt legitimate businesses who really have photographers’ best interests at heart (like TinEye and others) because it does the ultimate lowball–free.

And just how accurate will the results be anyway? Think about it: Google practically controls search. It has promoted groups who abuse copyright. Do you really trust that it won’t manipulate the results of any Image Search so as to avoid hurting itself or its friends? I don’t. Maybe it’s a bit tinfoil-hat-ish, but having Google say “trust me” makes me immediately suspicious.

Finally, I can’t find how Google will use the images you upload for the search. All I can find is a link referencing its Privacy Policy, but nothing about copyright. That scares the hell out of me.

Sure, it’s easy to use Google. And the idea of being able to search for your images is compelling, especially for free. But is it right to use Google rather than one of the legitimate companies like TinEye or PicScout? I say “no.”

Vision = value

I sell (and I use that term loosely because I don’t promote them much and thus sell few) t-shirts that say that: Vision = value. You can get one here, if you are so inclined, but that’s not why I’m writing this post. I’m writing it because I wish I had a big, magical, cartoon-like mallet with this imprinted on it, with which I could smack some of you in the head and somehow get the concept into your thick skulls.

Harsh? Maybe, but said with frustrated love.

If you are struggling with your photography business, it is likely that you are not being a visionary. You must be a visionary because without having and being true to your own, individual vision, you cannot survive in the photo business today. So, if you are struggling, either you aren’t developing your own vision in your images or you aren’t promoting that vision well, or both.

Yes, it really is that simple at its core.

You can tell if you aren’t developing your own vision if you do any of these:

1) focus on your gear–especially if you buy new gear often;
2) get defensive about the gear others use, especially when one touts something like the iPhone as a legitimate tool;
3) follow trends like the HDR fad or tilt-shift or whatever is next;
4) try to make work like any other (more successful) photographer;
5) haven’t shot a self-assignment in over a month.

You can tell you’re not promoting the work well if you:

1) spend most of your time in social media land interacting with other photographers;
2) regularly spend more on gear than marketing;
3) have a website with a combination of categories including any variation on “people,” “places,” and “things”;
4) can’t name off the top of your head 10 top-priority targets you want to work with more than anyone and be able to articulate why you want to work with them;
5) haven’t sent a print mailer out in over 6 months;
6) haven’t made any calls to get your book seen in the past two weeks.

Neither of those lists are exhaustive, by the way.

Deep inside, you know if you are wussing out and not going for it full-on. Is it risky to make your work, only your work, and to put that out to the world? Sure. You will get rejected by some (many) and your ego will take a beating.

But it’s riskier from a business perspective not to.

You’ve got no chance to stand out unless you stand out. Again yes, at its core it really is that simple.

So here’s my challenge to you: look at your work on your site. Do you love it–all of it? Does it make you smile/get you excited/make you want to do more of it? Be honest–don’t look at it from its technical side and definitely do not ask “Do I think buyers will want this?” If you do, then look at your marketing.

If you don’t, then get off your creative butt and start making the work that you make out of love and that weird compulsion that makes you do this and not be a 9-5 “normal” person.

Remember, if vision = value then, by logic, no vision = no value. You don’t want to be there.

Knowing Value

I just read this story, and I’m having a hard time corroborating it. I’m also having a hard time refuting it, so, because it sounds plausible, I’m posting it. But just know, it may be an urban legend.

In 1972, M*A*S*H debuted. It wasn’t expected to be much of anything but a chance to make a series, relatively cheaply, using leftover sets from the Altman film. It turned out to be the only hit for FOX (although it aired on CBS, it was a FOX production) at that time.

Three years later, FOX was in financial trouble again and two of the stars of M*A*S*H left, so, panicking, it decided to try to make some fast money. It offered local stations a deal: for a flat $13K an episode (non-refundable) the stations would have the rights to run the shows, years later, when they were syndicatable. Stations jumped at the chance and FOX made $25 million.

When the show could run locally, in 1979, M*A*S*H was still hugely popular and each of those local stations grossed over $1 million for each episode. That’s 168 episodes… so $168 million, per episode, made by the stations, for an investment of $13K (per).

FOX made nothing more.

The point? FOX sold something without respecting its potential future value.

I’m afraid too many photographers are doing this today. Think about future values. Consider negotiating deals where future value is a factor by accepting a low fee now but with more down the line. For example, structure a system for a small company with potential for growth, that wants you to shoot for their website. They’re growing, with the hopes of having an IPO in the future–build in a tiered pricing system where, if they hit X revenue or have their IPO, you get a bonus. That makes you a stakeholder in their success–part of the team–and gives them confidence that you are really interested in their best interests as well as your own.

Basically, be creative in your pricing, and don’t give it away. You never know when you’re sitting on a Nike swoosh or a M*A*S*H episode.

Fear and the Law and the Arts

Today I took my oaths and became a real, licensed attorney. The ceremonies and speeches were rather moving and often, during the speeches, I thought about you, the photographers and other creatives with whom I have worked for so long. Surprisingly, much of what was said applied to you as well as us, the new attorneys.

There was one speech in particular that really struck me. One of the officers of the State Bar of California talked to us about fear in the profession. He explained that he had suffered from severe anxiety after being in combat, which resulted in him being afraid of speaking in public. He was afraid even to be in a room with more than one or two others. He was terrified of trying to communicate with anyone. And during all this, he was applying for law school–wanting to pursue a profession which required him to do everything that scared the hell out of him.

He explained that over time he read everything he could about fear to try and figure out what was going on (this was before we understood about PTSD). After a while, he began to realize that whatever he feared was inevitably in his path to success–from simple things like asking a girl out to his desired profession, no matter what he wanted, he’d have some fear block his path. But other things didn’t scare him–and those things were not on his path to success. He realized that if he let the fear win, he’d never get what he wanted, so he did what he needed to, scared out of his wits as he did it.

Then he turned and gestured to the long row of judges (federal and state appellate–about 12 or so of them) seated behind him. He said, “They are afraid. Every day, they are afraid. Every day I am afraid. Every day, every one of us is afraid.” He then went on to say, essentially, that we need to lean into our fear to get where we want to go. He said that for him, he knows now that if something scares him, that is his sign that he needs to do whatever that scary thing is. If he avoids it, he will be avoiding something that will bring him more success.

I loved that speech. It was wonderful, honest, and I knew from my own experiences that he was right. I know he was right for me and for you. Lean into your fears if you want to be successful.

 

There was one other thing that struck me in the speeches that I thought I should share with you. As we were about to take the oath to be admitted to the Federal District Court for the Southern District of California, an 80+ year old Federal Judge said, with deep sincerity, that whatever we do in our lives and careers, we must not stop being idealists. When he said that, I was brought to the verge of tears because, throughout my life, I have been called an idealist. This was never said as a positive–it was always said like it was something bad. Well, I am an idealist and I’m not going to apologize for it ever again.

I think all artists are also idealists. You have to be to do what you do. If you weren’t, if you didn’t hold the belief that art, your art, is of enough value to make a living making it, you’d be an accountant or firefighter or whatever. Hold onto that idealism and don’t you apologize for it either.

Bits and Pieces

First off, I want to thank Heather Elder for the shout out in your fantastic interview on Adbase.com. And photographers, if you haven’t listened to the interview, you really, really need to. She offers a ton of information about what she and her group are doing to drive their success–you can use a lot of her tips.

Pay particular attention to what she and her group are giving to their clients (note they are not giving away the work!) and how they are interacting. I was particularly struck with the part where she says that it’s not all about the work (images) anymore. So true… and that is not a bad thing, really. It does mean, however, that if you are one of those photographers who doesn’t like people (and yes, I have heard that from more than a few of you), you are in for a tough future. Now is the new relationship marketing and I think it’s going to stick.

Next, I wanted to mention that today is my last day as a non-lawyer. Tomorrow (June 1) I take my oath and get admitted to the California Bar. I’ll also get admitted to the Federal Court, Southern District of California at the same time. That second admittance is kind of important in our world since copyright is a Federal Court thing (to put it in lay terms)–that is, if you want to sue for infringement, you have to do that in Federal Court.

Anyway, my point in mentioning tomorrow is two-fold: 1) I want people to know that I will be an official, real-life lawyer (finally!) and so will be available to help on legal issues; and, 2) I want to thank everyone again for all the fantastic support you have given me on the road to this goal–every email, post, etc., of encouragement has meant the world to me.

Oh, and the lawyer training makes me do things like write “1)…. ; and, 2)…” Ha! I’ll try to keep the legalese to a dull roar and avoid using words like “preclude” on this blog or in the work I post on my new BAP2Go app.

Third bit: As we’re rapidly approaching the mid-point of the year (where did the first half go?!), many of you may be feeling a bit like you have fallen off the rails. That’s okay. It’s pretty normal. All those big plans made at the beginning of the year may have gotten a bit lost as real life slipped in. Still, you can make some significant changes in your business and your life before this year comes to a close. I really like this article which offers 60 small things you can do over the next 100 days.

One big warning though: do not try to do everything! Pick just a few (like less than 5) and focus on doing those well rather than trying to do it all. There will be another 100 days and you can add new things then. Or maybe you can pick a couple now, and after 30 days or so, add a couple more… rinse, repeat.

Looking Outside

A couple of days ago Carolyn Wright (PhotoAttorney.com) asked me to look at a contract that has generated some discussion in the photo community and do some research/analysis on it. I did and she posted the results along with her thoughts on her blog (here). I was really honored that she thought well enough of my work to post it with only a few small edits. I felt all lawyer-y (even though I’m not one until June 1) and rather proud of myself.

As soon as it was posted, I emailed my father, a retired attorney, and sent him the link. I thought that he’d read it and let me know how he thought I sounded professional or something. But he didn’t. In fact, I didn’t hear anything from him.

When I later spoke with him I asked if he had read it.
He said he had.
That’s it.
I asked what he thought about it.
He replied that he wasn’t qualified to judge.
I said “You practiced for how many years?! Of course you are!”
But he countered with “I never did anything with intellectual property so I have no idea what you’re talking about there.”

In other words, I couldn’t get a pat on the back out of him about that post for anything.

And suddenly, this thing I had done didn’t seem like such an accomplishment after all. Poo.

The reality is that the accomplishment is just as significant as it always was. The trouble was that I was too trapped in looking for external validation to see what I had done for its own worth, in my own heart and mind.

See, I had done what many creatives do all the time: I looked for validation outside and when I didn’t get it, I devalued what I had done.

How often do you get excited about a project, a promo idea, an image you’ve made, or something you have done only to have someone else not get as excited about it as you were? How often do you let that become a disappointment and affect how you see your idea/image/whatever?

Well, stop it.

Being a creative professional means that above all else, you need to have the faith in your own creativity. That means if you think your idea/image/whatever is great, it’s great, no matter what anyone (even a consultant like me) might say. You can’t look to others for that validation–you must generate it from within.

As others have noted, you will hear a whole pile of “no” before you ever get a “yes” in this business. So, in my opinion, you have to have your own belief in your work/creativity/ideas as a rock-solid foundation to put up with all that negativity. The successful people of this world (not just creatives, but across the board) are those who believe first in themselves, no matter how nuts others think they are. They understand that what they create is of value and believe in that value, no matter what others say.

You need to be such a person, too.

Why is your mouth agape? That isn’t expensive… it’s cheap, actually. I wanted to price it closer to $100, but getting you people to pony up for anything that doesn’t have its own chip or lens is just about impossible so I settled for $59.99. 🙂

After Apple takes their chunk and you factor in the costs for development and maintenance and the time I’m putting in generating new content and, well, I’m not making much. Actually, the more I think about it, the more I think I should raise the price.

What gets me is how difficult it seems to be for y’all to recognize the value. And then I thought about it and realized that it’s not really so surprising after all since y’all (many of you) have a horrible time valuing your own work! So, let me explain the value in my work and, hopefully, you’ll see how this price isn’t high, it’s if anything low. Maybe it will help you reframe how you look at the value of your own work, too.

First off, I’ve got years of experience in the industry. Lots of years. More years than I really want to admit some times. The point is, the old story about Picasso doing a drawing in very little time and charging $50K or whatever applies here: it’s not that it took me two hours to write one of the articles I posted on the app… it took me my entire professional career to be able to do it. And there are multiple articles. And more are going to be added over time.

Second, same dynamic for the podcasts–your getting deep, sound knowledge. Plus, the annual subscription for the Creative Lube podcast was $80, but you get it built in to the app–no muss, no fuss. Fiscally, then, you’re already ahead in year one, but with each new addition, your cost drops again and again because you are getting more and more.

Third, you get video/keynote-based presentations. There’s only one up there now, but there will be more and more posted. You don’t have to pay any more to get them they’ll just magically appear in the app. More stuff, not more $$.

Fourth, I’m a week from taking my oath and being a lawyer. While I won’t be able to give specific legal advice on the app (there are ethical issues involved) I will be able to discuss legal issues and can do so with more knowledge and authority than a non-lawyer. You’ll be getting all that info too, again at no additional cost.

Fifth, the photographers and others who are offering advice up for free? Well, they are making their money as photographers or reps. That’s fine–good for them– but I am a consultant (and soon lawyer). This is my profession. I went to law school because I wanted to learn more to help photographers. As this is my profession, I make money by sharing my expertise… for a fee. I put my time and energies into studying the business of photography, not what new camera is out there or what lighting system to use. I’m not trying to produce a shoot while I’m trying to write a podcast. My focus is entirely on the business of being a creative businessperson and how my clients can be more successful at it. That’s all and that’s everything. And that is of great value.

In sum, what you are getting is like a book, but one that will increase in volume and value over time–like an expanding photography business encyclopedia, but all in your pocket.  What you pay for today will be worth more in three months, and even more in 6, and still more in a year, etc. So, the app is actually an appreciating asset, and those are damn rare these days.

I know many of you have and will spend (possibly much) more than the price of this app for a static, print book of Avedon’s images which, while gorgeous, won’t do as much for your business (it will help inspire, of course). Doesn’t it make sense to spend not quite as much on something that is of a greater value to your business today and will be of even greater value tomorrow?
